As many of you are likely aware, the TCPA restricts telephone solicitations (i.e., telemarketing) and the use of automated telephone dialing system (ATDS), artificial or prerecorded voice messages, SMS text messages and fax machines. Violations of the TCPA can cost companies millions of dollars. Hundreds of class action lawsuits have been brought. Settlements across a variety of industries have caused companies to beef up compliance. The webinar will review updates and cases from the past year as well as what to expect in the year ahead.
We’ve recently discussed whether the Seventh Circuit will weigh in on ascertainability in TCPA cases, the FCC’s recent ruling in Phillips v. Mozes, Inc. regarding whether “capturing” a phone number via text message is considered express consent, and Sterk v. Path, Inc., which clarified that the TCPA bars the improper use of an ATDS.
